Petitioner impugns the action of the respondents in proceeding further with the demand-cum-show cause notice dated 18.09.2020 on the ground that the same is barred by limitation in view of Section 28

(9) (b) of the Customs Act, 1962.

Learned counsel for respondents submits that pending the subject petition, the show cause notice has already been adjudicated and order-in-original dated 29.11.2023 has been passed. 3.

Though the petitioner has filed an application seeking amendment of the petition, petitioner seeks leave to withdraw the W.P.(C) 14638/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
