This application has become infructuous as the same has already been disposed of vide order dated 30.07.2024.

Learned counsel appearing on behalf of the respondent, on instructions, submits that he does not have any objection if the present petition be partly allowed by making it clear that the appellate authority shall pass a fresh order while taking into account the vigilance report as has been held by the learned Central Administrative Tribunal vide impugned order dated 30.11.2017.

It is agreed by learned counsel for the parties that order of the disciplinary authority as well as the inquiry report shall remain in force.
