JUDGMENT
BRIJESH SETHI, J (oral) Quashing of FIR No. 321/2019, under Section 420 IPC, registered at police station Jyoti Nagar, Delhi is sought by petitioner on the ground that dispute between petitioner and respondent No.2/complainant stands amicably resolved in terms of Compromise Deed of 2nd November, 2019. Notice.
Mr. Amanpreet Singh, Advocate appearing on behalf of Mr.Rahul Mehra, Standing Counsel respondent No.1/State submits that respondent W.P.(Crl.) 3234/2019
No.2 is present in the Court and has been duly identified to be complainant of FIR in question on the basis of identity proof furnished by him.
Respondent No.2, present in the Court, submits that the dispute between the parties has been amicably resolved in terms of Compromise Deed of 2nd November, 2019 and terms thereof have been fully acted upon as today, he has received the balance settled amount of Rs.7,00,000/- by way of demand draft bearing No.046657, dated 11th November, 2019, drawn on AXIS Bank, New Delhi from petitioner. Respondent No.2 submits that now, no grievance against petitioner survives and so, the FIR in question and proceedings emanating therefrom be quashed.
Since the subject matter of the FIR in question stands mutually and amicably resolved between the parties, no useful purpose would be served in continuation of proceedings arising out of FIR in question. In view of the above, FIR No. 321/2019, under Section 420 IPC, registered at police station Jyoti Nagar, Delhi and the proceedings emanating therefrom, are hereby quashed qua petitioner.
