The petitions essentially are for allotment of an alternate suitable accommodation to the petitioners by completing the entire process of allotment in a time-bound manner. It is the case of the petitioners that they are residing at the slum property for more than 20 years. They claim that there exists a policy that entitles them for allotment of alternate accommodation.

following decisions:

"4. Following the receipt of eligibility letters from the Property Branch of DUSIB, the Allotment Branch sent a letter to the concerned Executive Engineer of DUSIB requesting the vacancy status of vacant flats constructed under the Slum Clearance Scheme. In response, a consolidated report was received from the Superintending Engineer (Coordination) via letter dated August 4, 2021, which did not clarify whether the mentioned flats were constructed under the Slum Clearance Scheme, as DUSIB is required to allocate only those flats that fall under this scheme.

5. The report was requested again through letters dated January 3, 2022, February 3, 2022, and March 24, 2022, from the Engineering Wing, seeking a list of habitable flats constructed under the Slum Clearance Scheme. A response was received from the Superintending Engineer (Coordination) via letter dated October 12, 2022.

6. The matter has been submitted to higher authorities for consideration and approval to establish a "Draw Committee" that will conduct a draw to allocate flats to the eligible and ineligible beneficiaries of the aforementioned properties. This process is still pending finalization." 3.

It is, thus, seen that the entitlement of the petitioners for allotment of suitable accommodation is under active consideration. The respondents, therefore, will have to take it to its logical conclusion in accordance with extant policy. The respondents are, therefore, directed to treat the present petitions as the representations on behalf of the petitioners and to take an appropriate decision in accordance with law without any delay. 4.

The respondents to cooperate with each other, and the decision will have to be communicated to the petitioners by respondent no.2 within six weeks from the date of receipt of the copy of this order. 5.

All rights and contentions are left open. Petitions stand disposed of.
