O R D E R

% 06.04.2018 Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Petitioner and prosecutrix were living in the same building. He used to talk to the prosecutrix at which her parents got annoyed. It is further submitted that prosecutrix has stated in her statement under section 164 CrPC that petitioner had taken her to roof but left her there on seeing her brother. Prosecutrix had ample opportunity to shout but she did not raise alarm. Learned APP submits that the prosecutrix has categorically stated that in the intervening night of 23rd /24th June, 2017 petitioner put his hand on her mouth and took her forcibly to the roof. However, he left on seeing her father and brother. She could not shout as her throat was bad. She contents that allegations are serious in nature.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a

personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Dasti. A.K. PATHAK, J APRIL 06, 2018 sm
