By way of present application, the applicant/decree holder seeks release of the remaining balance amount that was deposited by the judgment debtor.

Learned counsel for the applicant/decree holder has drawn the attention of the Court to the order dated 19.05.2023, whereby it was noted that the amount of Rs.2,01,74,047/- has been deposited by the judgment debtor and further, was directed to be released to the applicant/decree holder against furnishing an appropriate security. He submits that the said amount stood released, however, as there was a shortfall on account of calculations, the judgment debtor further deposited a sum of Rs.7,48,256.52/-. submits that the decree holder had already furnished the security, as noted in the order dated 21.12.2023, which is more than adequate and covers not only the principal amount but also the balance shortfall. 3.

A perusal of the aforesaid order dated 21.12.2023 would show that the value of the security furnished by the decree holder is Rs.3,36,62,640/-. In light of the same, the Registry is directed to release the remaining balance amount to the decree holder.
