Further to the order dated 25.03.2025, learned counsel for the petitioner has taken instructions and submits that this writ petition may be disposed of, leaving the rights of the parties subject to the decision in the suit (CS DJ/616899/2016) pending in the Court of District Judge-09, Tis Hazari Courts, Delhi.

As recorded in the order dated 25.03.2025, an order of status quo against the respondents herein, with regard to the title and possession of the said property was passed by this Court on 31.05.2007, when the suit (CS (OS) No. 1109/2007) was pending before this Court. 4.

Learned counsel for the petitioner has undertaken yesterday, i.e., 25.03.2025, upon instructions from the petitioner, that the petitioner will maintain status quo as to the nature and character of the suit property and no construction will be carried out thereupon. He submits that this undertaking will bind the petitioner until the disposal of the civil proceedings.

In view of the above, the writ petition is disposed of, with the consent of learned counsel for the parties, binding them to maintain status quo as to the nature and character of the suit property, and title and possession thereof. The further rights and liabilities of the parties will be governed by the final decision in the said suit. 6.

The petitioner and respondents No. 1 and 2 are directed to file an affidavit of undertaking in this Court to the above effect within a period of two weeks from today.
