Writ Petition under Articles 226/227 of Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed for quashing of FIR No. 0191/2021 registered under Sections 420/468/471 IPC at P.S. IGI Airport and all the proceedings emanating therefrom.

It is submitted that the FIR had been registered on the complaint of Immigration Staff, IGI Airport when the Petitioner arrived as a deportee from Maxico via Amsterdam. During the arrival immigration clearance, on scrutiny of passport of the Petitioner, claimed that a Bolivian VISA affixed on page No. 5 of the passport No. R3482599 of the Petitioner, appeared to be fake. The Petitioner was arrested in the present case and remanded to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Police custody for 04 days on 10.07.2021. The Petitioner was released on Regular Bail on 14.07.2021.

The Chargesheet under Section 173 Cr.P.C. was filed for the offences under Sections 420/468/471 IPC read with Section 12 Passports Act, 1967 without VISA Verification Report, on 02.02.2022, no cognizance has been taken on the matter by the learned ACMM since there was no sanction under Section 15 Passport Act. The Notice was issued to Deputy Secretary, Home (Passport), GNCT for filing of requisite sanction. 4.
Despite repeated reminders to the Deputy Secretary, Home (Passport), GNCT, no sanction is filed because to which taking the cognizance was delayed. Serious prejudice was being caused to the Petitioner on account of the delay. Despite more than 03 years having elapsed, the present Petition has been filed seeking quashing of the Chargesheet. 5.
The Supplementary Status Report has been filed on behalf of the State wherein it is submitted that VISA Verification Report qua Tourist VISA bearing No. B021000743 issued to Indian citizen Jaskirat Singh (Petitioner) bearing passport No. R3482599 has been received. 6.
According to the Verification Report, it has been confirmed that the Tourist VISA issued on 16.04.2021 to the Petitioner of Indian nationality was issued by Honorary Counsel of Bolivia in Ukraine. 7.
Since the only allegation in the Chargesheet was that the Bolivian VISA appeared to be forged but the Report has been received that it is genuine, nothing survives in the present case. 8.
Accordingly, the FIR No. 0191/2021 registered under Sections 420/468/471 IPC at P.S. IGI Airport alongwith all the consequent proceedings emanating therefrom, is quashed.
