O R D E R

% 19.02.2018 Vide the present petition, the petitioner is seeking a direction to the respondent no.3/SDM (South-East), Sarita Vihar, New Delhi, to proceed in the matter for partition of joint holding of his agricultural land and to demarcate the portion of each bhumidar area as recorded in the revenue record of Khasra No.731 min.

At the outset, learned counsel for the petitioner concedes that the present petition is not maintainable, he, however, submits that the petitioner is a senior citizen and is facing grave hardship on account of in-action on the part of the SDM, to proceed in the matter. Mr.Rishikesh Kumar, Advocate who appears for respondents on advance notice, assures the Court that respondent no.3 will look into the matter expeditiously and take steps as per law. In view of the aforesaid statement made on behalf of learned

counsel for respondent no.3, the learned counsel for the petitioner does not press the present petition.

The petition and pending application are dismissed as not pressed.
