O R D E R

During the course of hearing, attention is drawn to a status report filed on behalf of SFIO (respondent no. 3). In the said status report, it has been stated that the LOC issued qua the petitioner in the case of Karvy Stock Broking Limited and Others has been 'downgraded' from 'PREVENT SUBJECT FROM LEAVING INDIA AND INFORM ORIGINATOR' to 'INFORM ARRIVAL/DEPARTURE OF SUBJECT (BUT NO OTHER ACTION TO BE TAKEN)'. It is submitted that the proposal to downgrade the LOC of the petitioner has been approved by the competent authority and the same has also been communicated to Bureau of Immigration (BOI) vide letter dated 08.04.2025. The said letter reads as under: "SFIO/INV-2/0003/2023-Admn./I/30714/2025 08th April 2025 To The Bureau of Immigration, East Block-VIII, Level-2, Sector-1, R.K. Puram, New Delhi-110066.

(Kind Attention: Assistant Director, BOI) Subject: Downgrading the Look Out Circular to "Inform Arrival/Departure of Subject (But no other action to be taken)" Adhiraj Parthasarathy- reg. Sir/Madam, I have been directed to convey that in respect of LOC issued, in respect of Shri Adhiraj Parthasarathy w.r.t. SFIO's letter no. SFIO/INV/Unit-II/12141223/KSBL/2021/1/2 dated 12.08.2021, has been downgraded with the approval of competent authority.

2. It is therefore, requested to downgrade the LoC of Adhiraj Parthasarathy to "Inform the Originator of the arrival/departure of subject (But no other action to be taken)".

3. Accordingly, BOI is requested to only intimate the Originator about the arrival/departure of the subject and not to take any other action.

4. This issues with the approval of the Competent Authority. (Amit Kumar) Senior Assistant Director SFIO, New Delhi"

Learned counsel for the respondents submits that in view of the aforesaid downgrading of the LOC, there is no impediment for the petitioner to travel out of India as and when he deems fit. He further submits that there is no occasion for the concerned authority at the airport to either detain or question the petitioner when he undertakes any foreign travel. 3.

It is assured by learned counsel for the respondents that appropriate instructions shall be given to the concerned immigration authorities to ensure that the petitioner is not subjected to any questioning/segregation or any inconvenience at the time of his undertaking any foreign travel pursuant to the aforesaid. Let appropriate instructions in this regard be clearly sent to the concerned Immigration authorities.

Given the aforesaid assurance and undertaking given by learned counsel for the respondents, the petitioner does not wish to pursue the present petition at this stage.

The petition is accordingly dismissed as withdrawn. Pending application also stands disposed of.
