The present Petition under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioner seeking interim bail for a period of one month which has been denied by the learned Trial Court vide Order dated 19.07.2024. 2.
It is submitted in the petition that the petitioner has not been provided effective treatment in the jail and he is continuously suffering from severe and acute pain in his abdomen, for which, he is only being provided with the pain killers.

It is further submitted that the petitioner is a young man of 22 years old and he needs proper treatment in a reputed hospital. 4.
Therefore, the prayer is made that the petitioner be released on interim bail for a period of one month.

Learned Additional Public Prosecutor on behalf of the State has opposed the present petition by submitting that as per the Medical Status Report received from the Senior Medical Officer of Jail, it is apparent that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the petitioner has been taken to Safdarjung Hospital, where he has undergone USG Scrotum which is suggestive of right Epididymo-orchitis with B/L mild free fluid in Scrotal-Sac and advised regular medication. It is submitted that the petitioner was prescribed only the conservative treatment which is being duly provided to him. 6.
It is also submitted that there are serious allegations of murder made against the petitioner. Moreover, the weapon of offence has also been recovered from his possession.

Therefore, the present petition has been opposed on behalf of the State.

The Medical Status Report qua the petitioner shows that the treatment recommended to him is conservative and the prescribed medicines by the Doctor of Safdarjung Hospital, Delhi are being duly provided to him. In these circumstances, no ground is made out for grant of interim bail. 10.
However, the Jail Authority is directed to provide appropriate medical treatment and follow-up treatment to the petitioner at Safdarjung Hospital, Delhi.

With the aforesaid directions, the present petition along with pending applications is disposed of.

The hardcopy of the Medical Status Report of the petitioner handed over today in the Court be taken on record.
