By way of present petition, the petitioner seeks quashing of Kalandra DD No.135A dated 01.03.2024 filed under Section 174 Cr.P.C. at P.S. Punjabi Bagh at which cognizance has been taken and notice has been issued by the learned Judicial Magistrate vide order dated 12.03.2024. 2.

Learned counsel for the petitioner submits that initially the petitioner, on receipt of notice under Section 160 Cr.P.C., had appeared before the IO however, no further notice was received after that. 3.

The above contention of ld. counsel for the petitioner is disputed by the Ld. APP for the State who states that three notices under Section 160 Cr.P.C. were received by the security guard employed by the petitioner. 4.

At this stage, ld. counsel for the petitioner, on instructions, states that petitioner undertakes to join the investigation as and when he is so directed. Be that as it may, subject to petitioner joining investigation on 05.08.2024 at 4 pm, the Kalandra filed under Section 174 Cr.P.C. as well as the order dated 12.03.2024 taking cognizance stand quashed. 6.

Petition is disposed of in the above terms alongwith pending applications.
