A Petition under Section 482 Cr.P.C has been filed on behalf of the petitioner for quashing of FIR No.25/2018 under Section 363/376/366 IPC and Section 6 POCSO Act registered at Police Station Sarita Vihar. 2.

Briefly stated the marriage between the petitioner and respondent No.2 was solemnized on 11.07.2018 according to Hindu Rites and ceremonies at Sanatan Dharam Mandir. At the time of marriage the parties were minor, hence, an FIR No.25/2018 under Section 363/376/366 IPC and Section 6 POCSO Act was registered at Police Station Sarita Vihar against the petitioner.

married couple having two children from their wedlock. Therefore, a prayer is made that the Petition be quashed.

The complainant is present in the Court and submits that the matter stands settled with the petitioner vide MOU dated 24.05.2024 and that she is living happily with the petitioner.

The petitioner and respondent No.2 submits that the Settlement has been arrived between them without any pressure, force or coercion and that they shall abide by the terms of the Settlement dated 24.05.2024. The respondent No.2 has no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties. Investigating Officer has identified the parties.

In view of the submissions made, the Petition is allowed.

Accordingly, the FIR bearing No.25/2018 registered at Police Station Sarita Vihar, for offences punishable under Sections 363/376/366 IPC and Section 6 POCSO Act with all the subsequent proceedings and the charge sheet is hereby quashed qua the petitioner.

The Petition stands disposed of.
