This petition has been filed seeking quashing of FIR no. 233/2017 registered at PS: Paschim Vihar, under Sections 341/354-A/ 354/ 352 / 506/509/34 of IPC basis the settlement dated 14th December, 2023 which is on record of this Court.

It is stated that the main accused Vikram has passed away on 03rd September, 2022. The other co-accused in the matter is present in Court. Respondent no.2 is also present in Court and is duly identified by the IO and states that she has no objection to the quashing of the said FIR. Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 233/2017 under Sections 341/354-A/ 354/ 352 / 506/509/34 registered at PS Paschim Vihar and proceedings emanating therefrom are quashed. 4.
Parties shall abide by the terms of settlement. 5.
Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
