O R D E R

% 01.03.2016 Vide this application under Section 439 of Cr.PC. the petitioner seeks regular bail in case FIR No. 126/2016 under Sections 323/379/452 IPC registered at Police Station K.N. Katju Marg, New Delhi.

It is submitted by counsel for the petitioner that on the date of incident, the petitioner had gone to attend a party where he consumed some liquor. The petitioner wanted to use the ATM to withdraw some money from the bank and when he went to the complainant to ask for help, some altercation took place with the complainant / guard who became furious and started scuffling with the petitioner. Thereafter the workers form the Sunrise Guest House also came there and joined hands with the complainant and the petitioner was beaten up mercilessly. After seeing his condition, the guard and the workers of the guest house made a call to the police and got him implicated in this false case.

It is further submitted that the petitioner is the sole bread earner of his family comprising his wife and two small children and there is nobody to look after them. He is a permanent resident of Delhi as such there is no chance of his absconding. As per the status report filed by the State, the recovery of weapon has already been effected; the investigation of the case has already been completed and the chargesheet is going to be filed shortly. The petitioner is in custody since 04.02.2016.

Keeping in view all the facts and circumstances of the case, the petitioner is directed to be released on bail on his furnishing personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of concerned Trial Court.
