O R D E R

The present applications have been filed under Section 438 Cr.PC. seeking anticipatory bail in FIR No.96/2023 registered under Sections 406/420/465/467/468/471/120B/34 IPC at P.S. Barakhamba Road. 2.

Learned counsel for the applicants submits that the parties have entered into a settlement before Samadhan, Delhi High Court Mediation and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Conciliation Centre on 11.12.2023, whereby the applicants had agreed to pay the settlement amount by way of installments as mentioned in paragraph 3 of the said settlement. He submits that the applicants have already paid two installments and that there was a slight delay in payment of third installment on account of illness of Mr.Vartik Kapoor's daughter. He submits that the cheque towards third installment has already been handed and the applicants assure that the same would be encashed, when presented. He further submits that the settlement agreement has been signed by Mr.Vartik Kapoor for his own self as well as for Mr.Deepak Kapoor. 3.

Mr.Vartik Kapoor, who has joined the proceedings through V.C., is identified by his counsel as well as by the Investigating Officer. He assures that the schedule mentioned in the settlement agreement would be strictly adhered to and payments in accordance with timeline will be paid. The statement made by Mr.Vartik Kapoor for his own self as well as for Mr.Deepak Kapoor is accepted, taken on record and they are made bound by the same.

Keeping in view the aforesaid facts and circumstances, the interim protection granted to the applicants vide order dated 17.11.2023 is made absolute and it is directed that in the event of arrest, the applicants be released on bail subject to them furnishing personal bonds in the sum of 25000/- each with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicants shall provide their mobile numbers, which they undertake to keep operational at all times during the pendency of the trial. (ii) The applicants shall join the investigation as and when asked.

(iii) The applicants shall inform the concerned Investigating Officer about their current residential address. (iv) In case of change of residential address/contact detail, the applicants shall promptly inform the same to the concerned Investigating Officer/SHO.

(v) The applicants shall not tamper with the evidence. (vi) The applicant shall regularly appear before the trial Court.
