Learned counsel for the petitioner submits that sister of the petitioner had filed a separate suit being CS(OS) 486/2024 titled as 'Shilpa Sadh vs. Mayur Shah & Ors.' wherein she had prayed for a decree of partition. 2.

He submits that during the pendency of the said suit, as well as, during the pendency of the present petition, the parties were referred to mediation where they arrived at settlement, terms whereof have been reduced in writing in the form of Settlement Agreement dated 07.10.2024. 3.

He submits that in the said settlement dated 07.10.2024, the sister of the petitioner, herein, namely, Shilpa Sadh has accepted the validity of both the Wills, one dated 20.05.2020 executed by Smt. Reshma Shah, the mother of the parties, and another dated 07.04.2021 executed by Mr Sneh Shah, the father of the parties.

withdraw the present petition.

The petition is dismissed as withdrawn. All the pending applications, if any, are disposed of.
