A request for adjournment is made on behalf of respondent Nos. 2 and 3 on the ground that the learned Senior Counsel is indisposed due to a medical emergency.

Mr. Manish K. Jha, learned counsel for the petitioner, states that a moratorium is in place in respect of respondent No. 1 - Shipra Estate Limited, by the order of the National Company Law Tribunal dated 24.01.2024.

Although notice to the Insolvency Resolution Professional has not been issued, Mr. Jha submits that the petitioner does not, in these circumstances, seek further orders in this petition under Section 9 of the Arbitration and Conciliation Act, 1996.

The petition is, therefore, dismissed as not pressed, with liberty to the petitioner to file a fresh application for the same relief, if possible, at a subsequent stage. All rights and contentions of the parties are left open in the event such an application is filed.
