Learned counsel for the defendant no. 2 has drawn this Court's attention to order dated 14.08.2024 passed by this Court and the statement and undertaking of the plaintiff and defendant nos. 1 and 2 recorded in the said order.

Learned counsel for the defendant no. 2 has placed before this Court the orders passed by the Trial Court on 23.10.2024, which records that proper stamp duty has been filed.

2.1. He states that the entire amounts towards stamp duty for drawing up of the decree as per judgment dated 16.10.2018 stands deposited with the treasury. He states that no objection has been marked by the treasury with respect to any deficiency in the stamp duty. deficiency stamp duty is marked, the defendant no. 2 undertakes that he will make good the said deficiency and deposit the amount within one (1) week. 3.

In view of the deposit of the stamp duty as recorded in the Trial Court order dated 23.10.2024, the aforesaid undertaking of defendant no. 2 and the undertaking of plaintiff and defendant no. 1 recorded in the order dated 14.08.2024, this Court is satisfied that the present suit is liable to be disposed of.

Accordingly, the suit stands disposed of along with all pending applications, if any.

All future dates stand cancelled.

Learned counsel for the plaintiff and defendant no. 2 states that they have filed objections before the Trial Court and they reserve their rights to raise all their objections.

Needless to state that the disposal of these proceedings will not preclude plaintiff and defendant no.

from raising any submissions/objections as available to them before the Trial Court as well as the Executing Court, in accordance with law.
