% 07.02.2017 By this petition, petitioner seeks quashing of FIR No. 866/2015 u/s 498A/406/34 IPC registered at PS Malviya Nagar. Petitioner no.1 and respondent no.2 have settled their disputes in the Mediation Centre, Saket Courts, Delhi vide settlement deed dated 30.10.2015 Respondent no.2 submits that marriage has already been dissolved by a decree of divorce by mutual consent dated 17th March, 2016 by the Family Court, Saket, Delhi. Respondent no.2, who is present in the court today, admits that she has already received a sum of `1,75,000/- out of total settled amount of `2,50,000/-. Demand Draft bearing no.226696 for a sum of `75,000/- drawn on SBI, Vasant Kunj Branch, New Delhi has been handed over by the petitioner no.1 to the respondent no.2 who accepts the same subject to its realisation.

Respondent no.2 submits that she is not willing to

pursue the present FIR any further.

Keeping in mind the facts that petitioner no.1 and respondent no.2 have settled their disputes amicably, inasmuch as, their marriage has already been dissolved and the entire settled amount has been received, in the interest of justice, in my view, no fruitful purpose would be served by continuing the present criminal proceedings. Accordingly, FIR No.866/2015 u/s 498A/406/34 IPC registered at PS Malviya Nagar and proceedings consequent/ emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.
