% 10.08.2018 In the on-going trial of the criminal case arising out of the FIR No. 364/2013 of police station DBG road, charges have been framed involving offences punishable under Sections 498A/306/201/34 of the Indian Penal Code, 1860. The petitioner is one of the accused persons facing the said trial.
The present petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C) has been filed on the ground no case is made out against the petitioner. It is conceded at the hearing that the trial is now at the final stage, the evidence for prosecution being almost complete as all the material witnesses have already been examined. The counsel for the petitioner now seeks permission to withdraw the present petition with a request that the trial court may be called upon to decide the case expeditiously.
The petition is dismissed as withdrawn.
The trial court is requested to decide the case at the earliest. R.K.GAUBA, J.
