By way of the present petition instituted under Article 226 of the Constitution read with Section 528 of BNSS, 2023, the petitioner seeks quashing of FIR No. 0453/2018 registered under Section 448 IPC at Police Station Alipur, Delhi, on the ground that the parties have amicably settled their disputes.

The allegations in the present FIR pertain to house trespass committed by the petitioner on the subject property statedly belonging to the complainant.

Ms. Nandita Rao, ASC (Crl.) for the State, on instructions, submits that the petitioner is the only accused and that the respondents are the complainants/victims in the present case. Learned counsel for the petitioner submits that the present FIR was registered due to a misunderstanding and that with the intervention of their family members and friends, parties have amicably settled their disputes, vide Memorandum of Understanding dated 26.06.2024, a copy of which has been placed on record. In terms of the said settlement, the complainants are now left with no claim or grievance against the petitioner. 5.
The petitioner, who is present in Court, has been identified by his counsel as well as the I.O./ SI Sandeep Kumar, PS Alipur, Delhi, who are also present in the Court. Respondent No. 2 is also present in Court and has been identified by the I.O.

Respondents No. 2 to 4 state that they have entered into the aforementioned MOU out of their own free will, volition and without any coercion. They further state that they have no objection if the present FIR and consequent proceedings are quashed.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed. 9.
The petition is disposed of in the above terms alongwith the pending application.
