% 31.05.2017 The respondent is served. None has appeared for the respondent. There exists an arbitration clause between the parties in the agreement dated 25.10.2012 being clause 39, which provides that in case of any disputes and differences arising out of or in connection with this agreement between the parties, the disputes shall be referred to the sole arbitrator to be appointed by the mutual discussion of the parties. The petitioner vide legal notice dated 07.11.2016 invoked the arbitration clause and suggested the name of learned arbitrator. Despite receipt of the said legal notice, there is no response from the respondent. None has also appeared today.
Petition is accordingly allowed. Mrs.Anjali Vohra, Advocate (Mobile No.9811087442) is appointed as the sole arbitrator to adjudicate the disputes and differences between the parties. The learned arbitrator may comply with provision of Section 12(1) of the Act. The learned arbitrator may fix her fees
in consultation with the learned counsel for the parties. JAYANT NATH, J.
