After hearing arguments for some time, learned counsel for the petitioner states that he may be permitted to withdraw the present petition with liberty to move the application afresh before the Recovery Officer, Debts Recovery Tribunal-I, Delhi to expedite the recovery proceedings as per the provisions of Rule 11 of the Second Schedule of the Income Tax Act, 1961.

Petition is, accordingly, dismissed as not pressed. Liberty, as prayed, is granted.

This Court has clarified that there is no observation with respect to the merits of the case as such. The Recovery Officer would be at liberty to take appropriate decision in accordance with law.
