Petitioner is respondent before the learned Trial Court and is aggrieved by order dated 02.05.2024 whereby his application moved under Order XVIII Rule 17 read with section 151 of CPC seeking recall of PW-1 was dismissed in default.

It was, specifically, asked from the learned counsel for petitioner whether he moved an application seeking restoration of such application or not.

The answer is, however, in negative.

After hearing the arguments for some time, learned counsel for petitioner states that he may be permitted to withdraw the present petition with liberty to move appropriate application seeking restoration of the aforesaid application.
