Petitioner is defendant before the learned Trial Court and is aggrieved by order dated 08.07.2024 whereby, while permitting the defendant to file written statement, it has also been burdened with cost of Rs. 20,000/- for causing delay in the matter.

Admittedly, written statement was not filed within the initial stipulated period of 30 days.

After hearing arguments for some time, learned counsel for petitioner states that he may be permitted to withdraw the present petition as not pressed with liberty to file appropriate application before the learned Trial Court seeking waiver/reduction of the cost.

It is clarified that this Court has not observed any opinion with respect to the merits of the contentions raised in the present petition and the learned Trial Court, as and when any such application is moved by the petitioner, would consider the same in accordance with law without getting prejudiced or influenced with any of the observations appearing in the present order.
