An application under Section 438 Cr. P.C. has been preferred on behalf of the petitioner seeking anticipatory bail in FIR No. 74/2023 under Sections 147/148/149/307/308/506/120B/34 IPC registered at P.S. Rani Bagh.

In brief, as per the case of prosecution, on 01.03.2023 a PCR call was received regarding quarrel at Jhuggis Sainik Vihar, Pitampura. Complainant alleged that since there was an argument between children, petitioner alongwith his brothers armed with knife and dandas came to the slum around 10:15 PM and shouted that they would kill everyone. attacked complainant and other slum dwellers. 3.
Learned counsel for petitioner submits that the vide order dated 10.11.2023 passed by Hon'ble Mr. Justice Saurabh Banerjee, interim protection was granted to petitioner, subject to his joining the investigation. He further submits that petitioner has since joined the investigation. Further co-accused Taj and Salman who are alleged to have inflicted the stab injuries are stated to have been released on bail and role of petitioner is claimed to be much lower. He also points out that simple injuries were sustained by all the injured except Pappu whose injury has been opined to be grievous.

On the other hand, application is opposed by learned APP for State. She points out that though the petitioner has joined the investigation but he failed to cooperate, as the correct mobile number which was in possession of the applicant at the time of incident was not shared. 5.
I have given considered thought to the contentions raised. Admittedly, co-accused Salman and Taj, who allegedly inflicted grievous injuries, have been released on bail. Petitioner has already joined the investigation since November, 2023. Chargesheet already stands filed against co-accused. Considering the facts and circumstances, in the event of arrest, petitioner be admitted to bail on furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount to the satisfaction of IO / SHO, P.S. concerned. Application is accordingly disposed of. Pending applications, if any, also stand disposed of.
