The plaint in CS (Comm) 240/2023 (Dream Square Hospitality LLP & Anr. v. Pradeep Sharan & Ors), of which this petition seeks transfer, stands rejected by the learned District Judge (Commercial) vide order dated 9 April 2024, albeit with liberty to file the suit afresh on the same cause of action after complying with Section 12A of the Commercial Courts Act, 2015, subject to limitation. 2.

In any event, as of today, the suit of which transfer is sought, does not survive. The Transfer Petition is rendered infructuous. It is accordingly disposed of.
