The present Petition under Articles 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioner seeking directions for investigation by the Central Bureau of Investigations or any other agency to ascertain the circumstances in which the FIR No. 233/2022 under Sections 406/420 of the Indian Penal Code, 1860 registered at Police Station Vasant Kunj, FIR No. 536/2022 under Sections 420/467/468/471/120B of the Indian Penal Code, 1860 registered at Police Station Kanjhawala and FIR No. 610/2022 under Sections 328/376 of the Indian Penal Code, 1860 registered at Police Station K.N. Katju Marg against the petitioner.

Learned Additional Standing Counsel on behalf of the respondents has submitted that the FIR No. 610/2022 under Sections 328/376 of the Indian Penal Code, 1860 registered at Police Station K.N. Katju Marg has been quashed by this Court. He further submits that the other two FIR Nos. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

233/2022 and 536/2022 in which the Closure Reports have been filed and the matter is pending before the learned Metropolitan Magistrate and the next date of hearing is 05.11.2024.

The grievance of the petitioner is that in these three FIRs which have been registered against him, an inquiry by the Central Bureau of Investigation or any other agency be conducted to ascertain the circumstances in which these FIRs were registered against him by the Police.

Learned counsel for the petitioner submits that the preliminary inquires before the registration of FIRs were conducted by Sub-Inspector Surender and thereafter, he got promoted as Inspector and this cannot be a coincidence.

Prima facie, no person can be aggrieved because of different FIRs registered at different Police Station which got investigated incidentally by the same Investigating Officer.

There are already Closure Reports submitted in the two FIR Nos. 233/2022 and 536/2022.

The petitioner is not aggrieved by the registration of FIRs, but he is looking for extraneous circumstances in which the complaints got registered against him.

The petitioner is at liberty to pursue the appropriate remedy as available under law.
