This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "a) Issue a writ of mandamus directing the respondents to take immediate and effective action to remove all encroachments and unauthorized constructions and closure of commercial establishments within 1350 LIG DDA Flats popularly known as "Jai Ambey Apartment", situated at New Kondli, Mayur Vihar Phase-3, Police Station - New Ashok Nagar, East Delhi, Delhi- 110096.

b) Issue a writ of mandamus directing a thorough investigation into the negligence of the respondents in failing to prevent and curb such encroachments.

c) Issue a writ of mandamus directing the strict adherence to building norms, fire safety regulations, and other relevant laws within 1350 LIG DDA Flats popularly known as "Jai Ambey The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Court has passed orders from time to time directing the respondents to take action and file status reports.

Admittedly, today, the Jai Ambey Apartment situated at New Kondli, Mayur Vihar Phase-3, Police Station - New Ashok Nagar, East Delhi, Delhi- 110096 lies in the jurisdiction of the respondent No. 3/MCD. 4.

Mr. Shukla, learned counsel for the respondent No. 3/MCD assures this Court that all illegal and unauthorised construction in Jai Ambey Apartment will be booked and appropriate action including demolition will be taken expeditiously and in any case not later than 12 weeks from today.

The respondent No.

3/MCD shall ensure that no property is reconstructed after the demolition action.

With these directions, the petition is disposed of. 7.

In case the Order passed today is not complied with, the petitioner will be at liberty to revive the petition and thereupon responsibility shall be fixed on erring MCD officers.
