CRL.M.C. 576/2017 & Crl.M.A. 2501/2017 (stay) Learned counsel for the petitioner states that as per the letter of intent awarded to the petitioner in case a demo instrument unit was given to him he was to give a security cheque. Thus the cheque which has been dishonoured was a security cheque and a part of service condition and could not have been encashed by the respondent. He further states that petitioner who is a resident of Hoogli, Kolkata has been unnecessarily dragged into this litigation causing serious inconvenience to him. Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to raise these pleas before learned Trial Court and also CRL.M.C. 576/2017

seek permanent exemption of the petitioner through counsel. Needless to state in case such an application is moved before the learned Trial Court, the same will be considered in accordance with law. Petition and application are dismissed as withdrawn. MUKTA GUPTA, J.
