This petition under Section 9 of the Arbitration and Conciliation Act, 1996 ['Act of 1996'] read with Order XXXIX Rule 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908 ['CPC'], has been filed by the Petitioner, praying for interim orders against the Respondent, thereby, restraining the Respondent from appointing a new catering service for Tamil Nadu House, Chanakayapuri, New Delhi and from taking any steps that would prejudice the Petitioner's right under the agreement dated 07.05.2024.

This Court by a separate order passed today in ARB.P. 1009/2025 has appointed Hon'ble Mr. Justice V.K. Jain, Former Judge, High Court of Delhi, as the Sole Arbitrator for adjudication of disputes between the parties, arisen out of the Agreement dated 07.05.2024. It has been directed that Arbitration be held under the aegis of Delhi Internation Arbitration Centre O.M.P.(I) (COMM.) 278/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Both the parties consent that this petition under Section 9 of the Act of 1996 be converted into a petition under Section 17 of Act of 19967 and be placed before the Ld. Sole Arbitrator for consideration. 4.

Accordingly, in view of the consent of the parties, the present petition shall be placed before the learned Sole Arbitrator to be heard and adjudicated as a petition under Section 17 of the Act of 1996. For this purpose, parties are directed to appear before the Sole Arbitrator on 22.07.2025 at 04:00 PM.

Learned counsel for the Respondent states that a short reply to this petition will be filed on or before 22.07.2025. 6.

The parties are directed to e-file their pleadings before the learned Sole Arbitrator.

With the aforesaid directions, the present petition stands disposed of. 8.

This petition will be listed before the learned Sole Arbitrator on 22.07.2025 at 04:00 PM.

The registry is directed to send a copy of this order to Secretary, DIAC and the learned Sole Arbitrator.
