Heard the learned counsel for the parties.

Essentially, challenge made in this petition is in relation to a bid which was floated for engaging an agency for up-keeping and cleaning work of Subway for Sub-Division SER-13 and providing service of security guard at sample stretch Lodhi Road and Ring Road (Ashram to Moolchand) under Sub-Division SER-13 & SER-14 of Division SER-1. 3.

Learned counsel representing the respondent has tendered before the Court a letter dated 03.09.2020, whereby the Executive Engineer concerned has foreclosed the said tender work.

relating to the bid is concerned.

However, other concerns raised in this writ petition cannot be overlooked. We thus dispose of this writ petition with the liberty to the petitioner to institute any fresh proceedings for rest of the prayers made in this writ petition.

We may, however, at this juncture only observe that it is the bounden duty of the Government and its agencies not only to ensure enforcement of the provisions of the Payment of the Minimum Wages Act but all other statutory requirements. We thus hope and trust that while issuing any fresh tender of this nature, the respondents shall ensure that statutory compliances are met by the tenderers.

We request the learned Standing Counsel representing the respondent to communicate this order to the Chief Secretary of the State who, in turn, shall communicate it to all the respective departments of the Government. 8.

With the aforesaid observations and directions, the writ petition alongwith pending applications stand disposed of. 9.

The next date of the hearing i.e. 22.04.2025 stands cancelled.
