The present application has been filed by the appellants seeking withdrawal of the instant appeal in terms of the Memorandum of Understanding dated 13.03.2024 ('MOU') entered into between the parties. 2.

The copy of the said MOU dated 13.03.2024 has been filed alongwith the application.

Respective counsel for the parties submit that the disputes between the parties stands resolved in terms of the said MOU dated 13.03.2024.It is also pointed out that the said MOU dated 13.03.2024, inter alia provides that respondent no.1 shall be allowed to withdraw the entire deposited amount of Rs.14,70,000/- lying with this Court along with accrued interest. 4.

Accordingly, taking on record the MOU dated 13.03.2024, the present application is allowed; the appellant is consequently permitted to withdraw the present appeal; RFA 1004/2019 is accordingly, dismissed as withdrawn. 5.

deposited by the appellants in this Court alongwith accrued interest, shall be released to the respondent no.1.
