The Petitioner claims to be the widowed daughter of Late Sh. Jai Singh Yadav, who was serving as a Vehicle Mechanic with the Border Roads Organisation (BRO). Upon the demise of Late Sh. Jai Singh Yadav, family pension was paid to his wife, who has since also died. It has been the case of the Respondents that since there is no reference made with respect to the Petitioner in service records of Late Sh. Jai Singh Yadav, her request for grant of family pension has been declined.

Even before this Court, the Petitioner has failed to produce any Government records or other cogent material to prove that she is widowed daughter of Late Sh. Jai Singh Yadav. determination of appreciation of highly disputed question of facts, which cannot be conveniently undertaken in a proceeding under Article 226 of the Constitution.

In view of the aforesaid facts and circumstances, the Petitioner is relegated to avail the appropriate alternative remedy of filing a civil suit, in accordance with law.

Keeping in view the aforesaid position, the present Writ Petition is disposed of.
