% 11.07.2024 At the outset, Mr. Gaurav Sharma, learned legal-aid counsel who was appointed to represent the complainant and had appeared on her behalf on 07.07.2023, submits that the complainant has not provided to him the requisite documents and instructions, and he is now informed that the complainant has engaged private counsel. 2.
In the circumstances, Mr. Sharma seeks discharge as counsel for the complainant in the matter. In view of the above, Mr. Gaurav Sharma, Advocate is discharged as counsel for the complainant in the case. 3.
Mr. Devanshu Chauhan, learned counsel enters appearance on behalf of the complainant, submitting that he has been engaged recently. He seeks time to work-up the brief.

The record shows that the petitioner was granted a 'no coercive steps' order on 25.11.2019, when the court had also observed that considering the dealings between the petitioner and the complainant, it would be relevant to determine whether the transaction was a civil dispute or whether there was a possible element of cheating. The interim protective order has been continuing ever-since. 5.
Dr. Ashwani Bhardwaj, learned counsel appearing for the petitioner submits, that as the record would show, the complainant has not participated in the proceedings with any seriousness. 6.
On instructions of the Investigating Officer ('I.O.'), who is present in court, Mr. Manoj Pant, learned APP appearing for the State submits that the petitioner has co-operated in the investigation. However, he states that it would take another 2 to 3 months for the I.O. to complete the investigation.

In the above circumstances, the present anticipatory petition is disposed-of, directing that in the event of her arrest, the petitioner shall be admitted to bail by the Investigating Officer/Arresting Officer on the following conditions :
7.1.
The petitioner shall furnish a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with 01 surety in the like amount from a family member to the satisfaction of the Investigating Officer/Arresting Officer;
7.2.
The petitioner shall furnish to the Investigating Officer a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

7.3.
The petitioner shall cooperate with the on-going investigation; and shall appear before the Investigating Officer, if and when called.
7.4.
If the petitioner has a passport, she shall surrender the same to the Investigating Officer and shall not travel out of the country without prior permission of the learned trial court; 7.5.
The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.

The petition stands disposed-of, in the above terms. 9.
