The present writ petition has been filed seeking directions to respondent nos. 1 and 2, i.e., Municipal Corporation of Delhi ("MCD") to take action against the unauthorized construction, being raised by respondent no. 3 in the property bearing No. C-40, Vijay Vihar, Phase - I, Near Buddha Bazar Road, Rohini, Delhi-110085. 2.
The aforesaid contempt petition has been filed seeking action against the respondents for willful disobedience of the order of this Court dated 18th The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
July, 2025, passed in the aforesaid writ petition, stating that despite directions by this Court, further illegal and unauthorized construction was being carried out by respondent no. 3 in the property in question. 3.
Today, learned counsel for the MCD submits that partial demolition action has already been taken on the ground and first floor of the property on 06th October, 2025.

Learned counsel for the Station House Officer ("SHO"), Police Station-Vijay Vihar, has handed over a copy of the Status Report filed on behalf of the SHO, Police Station-Vijay Vihar, which is taken on record. 5.
Learned counsel for SHO, Police Station-Vijay Vihar, also confirms the fact that partial demolition action was taken with the assistance of the local police on 06th October, 2025.

At this stage, learned counsel for the petitioner submits that action has been taken partially on the ground and first floor of the property, whereas, respondent no. 3 has constructed till second floor, which is also unauthorized.

This Court also takes note of the submissions made by learned counsel for the MCD that prosecution action under Section 466A of the Delhi Municipal Corporation Act, 1957 ("DMC Act"), has also been initiated against respondent no. 3.

The MCD, as well as SHO, Police Station-Vijay Vihar, are bound to ensure that no further unauthorized construction takes place in the property in question.

Considering the submissions made before this Court, it is directed that the MCD, with the assistance of the local police, shall take further action on the unauthorized construction existing in the property in question. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

MCD is held bound to take a time bound action, expeditiously. 11.
It is further directed, that in case, the petitioner is aggrieved by any non-action on the part of MCD, the petitioner is at liberty to approach the Special Task Force ("STF"), as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., in W.P.(C) 1807/2018, and Fazruddin Versus DDA and Ors. in W.P.(C) 4649/2017. 12.
Likewise, in case, the respondent no. 3 is aggrieved by any action taken by the MCD, the right of respondent no. 3 to seek his remedies, in accordance with law, is reserved.
