The present petition under Sections 2(b), 10 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a) Hold the Respondents guilty of Contempt of Court for willfully and deliberately flouting the order and the decree dated 17.05.2025 so passed by the Court of Ld. District Judge -02, South, Saket Court, New Delhi in 3 CS DJ No. 3905/2024 titled as "Mrs Harinder Sachdev Vs Dr. Nikhil Sinha & Anr", in pursuance to the Statements of the Respondent No. 1 and the counsel for Respondent No.2 on behalf of Respondent No. 2 recorded by the Ld. Court on 17.05.2025 and punish them in accordance with. law; b) Direct the Respondents to vacate and handover the vacant peaceful possession of the tenanted premises situated in the property bearing no. S-359A, Panchsheel Park, New Delhi-110017 to the Petitioner forthwith;
c) pass such other and further orders as, in the circumstances, shall be just and appropriate."

"2. Learned counsel appearing on behalf of the respondents enters appearance and submits that an application for appointment of Local Commissioner in CS DJ 3905/2024 has been filed on behalf of the respondent in order to assess the damages with respect to the counterclaim made on behalf of the respondents in the said suit. It is submitted that before the said Court a statement was given to the effect that the respondent is ready to give the keys of the suit premises after the examination of the said property by the Local Commissioner. It is further submitted that the said application is listed before the concerned Court on 28.08.2025.

Learned counsel for the parties submit that a joint request shall be made before the concerned Court for the appointment of a Local Commissioner at the cost of the respondent, and that thereafter, upon completion of the inspection, the keys shall be handed over to the petitioner before the said Court itself.
4. List for compliance on 11.09.2025."

Learned counsel appearing on behalf of the petitioner submits that the keys of the said property have been handed over and therefore, he does not wish to press this petition.

In view of the above, the present petition is disposed of as not pressed. 6.
