O R D E R

The petitioner has filed the present petition, inter alia, praying for an anticipatory bail in FIR No. 243/2019, under Sections 420/34 of the IPC, registered with Police Station Jaitpur.

The said FIR was registered at the instance of one Mohd. Arif. He had alleged that some persons, including the petitioner herein, had replaced his ATM Card and had misused the same to withdraw money from his bank accounts, as well as purchasing various goods from multiple outlets. 3.

Admittedly, the petitioner and other co-accused have settled their disputes with the complainant and have compensated him for the money withdrawn from his bank account and the expenditure incurred on his card. The petitioner and other co-accused had also filed a petition for quashing of the FIR on the basis of the settlement arrived at with the complainant. Given the nature of the offence and also considering the report that several ATM

cards were reportedly found in possession of the accused persons, the said petition was not allowed.

The other co-accused have been released on bail and there is no dispute that the petitioner has also joined the investigation. In the aforesaid circumstances and considering that the petitioner and other co-accused have already settled their disputes and have also compensated the complainant, this Court considers it apposite to allow the present petition. 5.

The petitioner is admitted to anticipatory bail on his furnishing a personal bond in the sum of ₹20,000/-, with two sureties of the equivalent amount to the satisfaction of the Investigating Officer. The petitioner shall continue to be available for investigation and cooperate with the IO. He shall provide such information as required by the IO and as may be available with the petitioner.

The petitioner shall also report before the concerned SHO on second and fourth Monday of each calendar month at 10.30 a.m. 7.

The petitioner shall not contact and influence any witnesses, either directly or indirectly.
