O R D E R

% 24.01.2018 Mr. Mukesh Gupta, learned Standing Counsel for the NDMC has filed a latest status report in the Court today. The same is taken on record. Para 3 of the status report reads as under:

"3.

That the deponent state that on availability of the police force on 02.08.2017, the police force was no made available, however, another demolition action program was organized on 09.10.2017 and the part of the remaining unauthorised construction in the shape of roof slab of second floor and common passage had been damaged partly, the floor slab of one shop at third floor was demolished and the two shutters installed at third floor has been cut down by gas cutter. Further, action was taken on 08.01.2018 and the seven No. of shutter installed at third floor was removed, three walls of shops at third floor were demolished and three roofs of shops of second floor were demolished. The another demolition program has now been organized in the month of February, 2018 and on availability of police force under the jurisdiction of P.S. Hauz Qazi, the

remaining unauthorised construction at the property in question will be demolished. The photographs of the demolition action taken at the property on 09.10.2017 & 08.01.2018 and copy of the police requisition dated 22.01.2018 are annexed herewith as Annexure-R-1(Colly).

In view of the facts as stated above, the contempt petition filed by the petitioner against the answering respondent is liable to be dismissed and the same be dismissed.

It is deposed accordingly."

Mr. Gupta states, 90% of the second floor and third floor have been demolished and 10% shall be demolished within one week. The statement is taken on record. If the petitioner is still aggrieved, he shall be at liberty to revive the same.
