The Petitioner has preferred the present Petition seeking stay of execution of the Order dated 31.05.2025 passed by the Office of District Magistrate-cum-Appellate Tribunal for Maintenance and Welfare of Parents and Senior Citizens, District-South West, Delhi ("Appellate Tribunal"), whereby the learned Appellate Tribunal had concluded that the Petitioner had ill-treated the Respondents and the Petitioner was directed to not interfere in the peaceful living and possession of the property of Respondents No.2 & 3.

The learned Counsel for the Petitioner has stated that the Petitioner has filed an Appeal against the Order dated 31.05.2025 on 28.06.2025 and the said Appeal is listed on 21.07.2025.

It is further submitted by the learned Counsel for the Petitioner that the Petitioner is on the verge of being evicted and is not being allowed to enter the matrimonial home by Respondents No.2 & 3. 4.

The learned Counsel for the Petitioner had also relied upon an order dated 09.12.2021 passed by this Court in W.P. (C)14039/2021, whereby this Court has observed as under:

"Since this Court is regularly coming across a number of cases where eviction orders passed in similar circumstances under the Maintenance and Welfare of Parents and Senior Citizens Rules, 2009, are sought to be executed even before the expiry of the limitation period prescribed for the appellate remedy, it is directed that a copy of this order be sent to the Principal Secretary (Revenue) to enable him to issue appropriate directions in this regard." 5.

In view of the fact that the Appeal filed by the Petitioner is stated to be listed on 21.07.2025, it is directed that till 21.07.2025, there shall be a stay on the Order dated 31.05.2025.

The Appellate Authority-cum-Additional Commissioner, Delhi, shall hear the Appeal filed by the Petitioner on 21.07.2025 and pass appropriate orders in accordance with law.

In view of the above, the present Petition is disposed of with the aforesaid directions.
