The present application has been filed on behalf of the petitioner under Section 439 Cr.P.C. (483 BNSS) seeking regular bail in connection with FIR No. 272/2024, under Section 304 IPC registered at PS Swaroop Nagar.

The case of the prosecution is that the petitioner caused multiple injuries by way of fist blows to the deceased (Ramesh) on his face and other parts of the body on account of which deceased (Ramesh) succumbed to his injuries.

Mr. Y.D. Sharma, learned counsel appearing on behalf of petitioner submits that prosecution has cited following four witnesses as eye witnesses, i.e., (i) PW-1 Surender Goel; (ii) PW-2 Ravi; (iii) PW-3 Vijay Chaudhary and (iv) PW-4 Ratan Singh Yadav, all of them turned hostile. 4.

Elaborating further, he submits that none of the witnesses have identified the present petitioner.

The aforesaid position is not disputed by Mr. Ajay Vikram Singh, the learned APP, on instructions from the IO, who is present in Court. In view of the above, this Court is of the view that the petitioner is entitled to regular bail. Accordingly, the petitioner is admitted on regular bail subject to his furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/JMFC/Duty JM, further subject to the following conditions: a. Petitioner shall appear before the Court as and when the matter is taken up for hearing.

b. Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

c. Petitioner shall not come in contact with or other witnesses. 7.

The application is disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance.
