% 22.02.2017 1.
The petitioner seeks parole for two months to participate in the marriage of his niece fixed for 01.03.2017. Status report is on record. I have heard the learned counsel for the parties and have examined the file.
2.
The petitioner was convicted under Section 376(2)(f) IPC in case FIR No.232/2000. He was sentenced to undergo RI for ten years with fine `1,000/-.
Crl.A.No.850/2001 preferred by him has been dismissed by this Court vide order dated 15.09.2016. 3.
The victim in the instant case was a child aged around 4 years. Perusal of the judgment dated 15.09.2016 reveals that after the W.P.(CRL) 448/2017
occurrence, victim's parents had shifted from Delhi to Agra due to alleged threats extended by the petitioner's mother. It further records that even after shifting to Agra threats were being extended to them. 4.
Recently, Hon'ble Supreme Court in the Lajpat Nagar Bomb Blasts case declined parole to the convict to participate in the marriage of his daughter, he being involved in a heinous offence. 5.
Wedding card reveals that there are other family members to participate in the marriage for which preparation have already been done.
6.
Considering the gravity of the offence and serious allegations against the petitioner, I find no merit in the petition and it is dismissed.
