The petitioner - State Bank of India ["the Bank"] has filed this writ petition against an order/recommendation of the National Commission for Scheduled Castes ["the Commission"] dated 11.01.2017. 2.

The said recommendation concerns a complaint dated 20.09.2016, filed by respondent No. 2 herein before the Commission, with regard to his transfer from one branch of the Bank to another. By the impugned decision, the Commission recommended that he should be allowed to continue at his erstwhile post until he completes two years of his tenure with effect from 19.09.2016.

The recommendation of the Commission was stayed by this Court by order dated 08.02.2017.

instructions, that respondent No. 2 has since been transferred to the place of his choosing in a subsequent transfer cycle, and the petition has therefore been rendered infructuous. Mr. Kapur submits that the present writ petition may therefore be disposed of, but without prejudice to the rights and contentions of the Bank on the question of the jurisdiction of the Commission in service matters.

The petition is disposed of in terms of Mr. Kapur's submissions, recorded above.
