% 28.02.2018 By this petition, the petitioner seeks parole on the ground that he has to get his mother operated for hernia and re-establish social ties. On a notice being issued status report has been filed. As per the status report the family of the petitioner was found residing as tenant in flat No. 3 (1st Floor), house owner- Sudhir Rana, Rana Market Village-Alipur, near Sarvodya Knaya Vidyala, PS- Alipur, Delhi for last one year. No date for surgery has been given, the reason being that there is nobody to take care of petitioner's mother and thus only after petitioner is released he would be in a position to get the date for surgery fixed. As per the status report wife of the petitioner is earning the livelihood by doing private job. The petitioner has been convicted in two other cases under Section 302/201 IPC and the sentence awarded to the petitioner is remainder of natural life.
As per the nominal roll, petitioner was granted parole for a period of 10 days by Hon'ble Supreme Court and four times furlough in year 2017.There is no allegation that when the petitioner was released on furlough/parole he did not surrender in time. Considering the past conduct of the petitioner and that the medical documents of the petitioner's mother have been verified and also the fact that the petitioner's family comprising of his wife, mother and five minor daughters is residing at Alipur, this Court deems it fit to grant parole to the petitioner for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the Superintendent, Tihar Jail. Petition is disposed of.
