O R D E R

% 22.01.2018 CO. APPL. 1400/2017, Learned counsel for the applicant/respondent company says that a perusal of the last order dated 25th August, 2017 would show that the prayer made in the captioned application was deferred to await the outcome of the challenge made to the award dated 6th June, 2017 passed by the learned Arbitrator.

Learned counsel for the applicant/the respondent company has placed before me the judgment dated 12th September, 2017, passed by learned single judge of this court in OMP (COMM) 336/2017. A perusal of this judgment shows that the petition filed by Petitioner herein under Section 34 of the Arbitration and Conciliation Act, 1996 against the award dated 06th June, 2017 has been dismissed.

Consequently, the prayer made in captioned application would have to

be allowed. It is ordered accordingly.

Resultantly, the pending Company Petition No. 158/2013 and all pending applications will stand dismissed. Interim orders, if any, will stand dissolved.

The case be consigned to Record.
