% 15.04.2024 Ms. Vibha Mahajan Seth, learned counsel appearing for the petitioner submits that during the pendency of the present petition filed under section 27 of the Arbitration & Conciliation Act 1996, the learned Sole Arbitrator who is seized of the matter has recused from the proceedings. Counsel submits that no steps have been taken by the respondent/claimant for appointment of a substitute arbitrator.

In the circumstances, Ms. Seth seeks leave to withdraw the present petition, with liberty to file afresh for the same purpose, if and when the Arbitral Tribunal is re-constituted.

Ms. Apoorva, learned counsel is present on behalf of the Resolution Professional appointed for the respondent company and submits that the company is undergoing Corporate Insolvency Resolution Process and is likely to be taken-over by a new management, which may then decide to take appropriate steps in respect of the arbitral proceedings.
