% 08.02.2017 Learned counsel for respondent No.2 submits that during the cross examination the moving of application under Sections 91 & 311 Cr.P.C. is bad in law, however, he has no objection if the petitioner does so after the cross examination is over.

At this stage, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file a fresh application at the subsequent stage.

In view of the submission of learned counsel for petitioner, the present petition is dismissed as withdrawn with liberty to the petitioner to file appropriate application after the cross examination is over. Copy of this order be given dasti, as prayed. I.S.MEHTA, J FEBRUARY 08, 2017/km
