During the course of arguments, it transpires that the parties are at variance with respect to the execution of the agreement dated 07.02.2023. 2.

It is an unequivocal stand taken by the respondent that this agreement has not at all been executed, and in absence of there being a binding agreement, the Court should not appoint an arbitrator. 3.

The respondents are bound by the said statement. The same would mean that they shall not be entitled to assert the existence of an arbitration agreement at a later point of time.

In view of the aforesaid, Mr. Sameer Dewan, learned counsel appearing for the petitioner, seeks liberty to withdraw the instant petition with further liberty to take appropriate recourse in accordance with law. 5.
