The present Bail Application has been filed for grant of Regular Bail under Section 483 BNSS moved on behalf of applicant/accused in case FIR No. 138/2024 under Section 21/65/85 NDPS Act registered at PS Adarsh Nagar.

Learned APP for the State submits that the status report was filed yesterday only. However, the same is not on record. Let the status report be brought on record. However, learned APP for the State has handed over the physical copy of the status report in the Court. 3.
Learned counsel for the petitioner submits that as per the case of the prosecution the petitioner was found with 7 gms. of heroine which is marginally above the small quantity. It has been submitted that there is no previous involvement of the petitioner. Learned APP for the state submits that this is a serious case where the petitioner was found in possession of intermediate quantity of drug and as per investigation he used to sell the same to co-accused Kishan. Since admittedly the quantity recovered is intermediate quantity and the charge-sheet has already been filed and the petitioner is in custody for the last 07 months and there is also no previous involvement of the petitioner.

In view of the circumstances, the petitioner is admitted to Regular Bail on furnishing a personal bond of Rs. 20,000/- with one surety of the like amount subject to the satisfaction of Ld. Trial Court subject to the following conditions:
a.
the Petitioner shall cooperate in the investigation and appear before the Investigating Officer of the case as and when required; b.
the Petitioner shall under no circumstances leave India without prior permission of the Court concerned;
c.
the Petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case;
d.
the Petitioner shall provide his/her mobile number(s) to the Investigating Officer and keep it operational at all times; e.
In case of change of residential address and/or mobile number, the Petitioner shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit.
